These terms apply all Goods supplied by Taran Microsystems Limited as PCBuyIT / www.pcbuyit.co.uk , whether you are ordering online, by telephone or by mail. Please read this document carefully after printing it off or downloading it (if you are using the Internet) before placing your order.
We may change these terms from time to time. Please check them before you make another purchase

1.1 "Consumer" means any customer who is purchasing outside the course of his or her business or trade;
1.2 "you" means the Consumer submitting an order for Goods;
1.3 "Goods" means the product and/or other equipment to be supplied under these conditions;
1.4 "Party" means either you or us; "Parties" means you and us;
1.5 "Software" means the computer programs to be supplied under these conditions as stated on our quotation or order acknowledgement, as appropriate.
1.6 "Writing" means letter, fax or email.
1.7 The contract for supply of Goods and any Support Services (if applicable) ("Contract") will be formed when you accept our quotation or we accept your order. Acceptance of an order by us can only be made in Writing. Once the Contract has been formed with you we will file it in electronic or paper copy for our records.
1.8 In deciding whether to accept your order we may carry out a credit check and then will only accept your order if we are satisfied with the results of such check. You confirm that you are happy for us to carry out such check. You agree that we may also use personal information provided by you in order to conduct appropriate anti fraud checks. Personal Information that you provide may be disclosed to a credit reference or fraud prevention agency, which may keep a record of that information.
1.9 These conditions may only be changed in a document signed by one of our directors.
1.10 These conditions and any matters referred to on our quotation or order acknowledgement (as appropriate) form the entire understanding between you and us and supersede any prior promises, representations (unless fraudulent) or undertakings.
1.11 Any omission or error in any sales literature, web page or site, order form, quotation, price list, order acknowledgement, despatch note, invoice or other document issued by us may be corrected by us without liability.
1.12 By accepting the Contract you are confirming that you are a Consumer.
1.13 The provisions of the Contracts (Rights of Third Parties) Act 1999 are expressly excluded from the Contract so that no third party may claim any rights under this contract.
1.14 Clause headings are for convenience only and do not affect the interpretation of these conditions. Words in the singular include the plural and vice versa.
2.1 All goods supplied by PCbuyIT are warranted free from defects for 12 months from the date of supply (unless otherwise stated). This warranty does not affect your statutory rights as a consumer.
2.2 This warranty does not apply to any defect in the goods arising from fair wear and tear, wilful damage, accident, negligence by you or any third party, use otherwise than as recommended by the Supplier, failure to follow the PCbuyIT's instructions, or any alteration or repair carried out without PCBuyIT's approval.
2.3 If the goods supplied to you are damaged on delivery, you should notify the PCBuyIT in writing via the e-mail address or fax number shown below within 2 working days.
2.4 If the goods supplied to you develop a defect while under warranty or you have any other complaint about the goods, you should notify PCBuyIT in writing via the e-mail address or fax number shown above, as soon as possible, but in any event within 14 days of the date you discovered or ought to have discovered the damage, defect or complaint.
2.5 You must obtain a returns number for any goods returned to PCbuyIT to our trading address above. The returns number must be clearly shown on the returned
3. Limitation of Liability
3.1 We will not be liable to you by way of representation (unless fraudulent), common law duty or under any express or implied term of the contract for.
3.2 any losses which are not foreseeable by both Parties when the Contact is formed arising in connection with the supply of Goods and related services or their use by you;
3.3 any losses which are not caused by any breach by us;
3.4 business or trade losses; or
3.5 any loss or costs of retrieval of data, as you should keep adequate back-up copies of data and programs held or used by you
3.6 Our entire liability in connection with the Contract will not exceed one and a half times the purchase price of the Goods and (if applicable) Support Services in question.
3.7 Nothing in this Contract means that our liability to you for death or personal injury resulting from our negligence or that of our employees, agents or subcontractors is limited.
4.1 Every effort is made to ensure that prices shown on PCBuyIT's website are accurate at the time you place your order. If an error is found, PCbuyIT will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If PCbuyIT does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel, PCbuyIT will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods.
4.2 The price for the Goods and/or Support Services is stated on our quotation or order acknowledgement (as appropriate). All prices are in £ sterling, are exclusive of VAT, and applicable delivery charges, all of which will be added to or charged on invoices at the appropriate rates and paid by you.
4.3 We may vary the price where the cost to us of acquiring or supplying the Goods is increased between the date of quotation or order acknowledgement (as appropriate) and delivery and including, without limitation, increases in the cost of carriage, packaging or insurance or arising from a change in exchange rate, a change in delivery date, quantities or specifications for Goods requested by you or delay caused by your instructions PROVIDED THAT we will notify you in writing in good time prior to delivery of such price increases and you may cancel your order within 7 working days of this notice if you are unhappy with the price increase.
5.1 Payment for the goods and delivery charges can be made by any method shown PCBuyIT's website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be of the essence.
5.2 There will be no delivery until payment funds have cleared or processed through our payment gateway and subsequent security checks
5.3 Where an alternative delivery address is provided by you and is not the registered card address , this will require addition security checking and may be subject to reversal at our discretion.
5.4 Payments shall be made by you without any deduction whether by way of set-off, counterclaim, discount, abatement or otherwise unless you have a valid court order requiring an amount equal to such deduction to be paid by PCbuyIT to you.
6.1 The goods you order will be delivered to the address that you specify when you place your order.
6.2 Orders placed before 5:00pm on a normal working day will be processed that day and will be delivered as per the requested delivery option, provided no additional security checks are required and all stock items are available. (A working day is any day other than weekends and bank or other public holidays.) Exceptions;
6.3 All standard Mainland UK orders placed before 5:00pm are shipped the same day the order is processed, with the exception of Amazon checkout 4:30pm, or if additional security checks are required, for delivery next working day via Federal Express before 5pm. For Mainland UK Zone 1,2 & 3 The Highlands and Islands of Scotland - postcodes IV, HS, KA27-28, KW, PA20-49, PA60-78, PH17-26, PH30-44, PH49-50, ZE, Northern Ireland, Isle of Man and Isles of Scilly -postcodes BT, IM, TR21-25 orders placed before 3pm are despatch the same day delivery timescales vary on destination but are typically 2-3 working days. For Orders shipping outside the UK to EU destinations the order cut off is 3pm
6.4 If delivery cannot be made to your address for reasons under PCbuyIT's control, PCbuyIT will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery.
6.5 If you deliberately fail to take delivery of the goods (otherwise than by reason of circumstances under control of the Supplier) then without prejudice to any other right or remedy available to the Supplier, the Supplier may:
6.5.1 store the goods until actual delivery and charge you for reasonable costs (including insurance) of storage; or
6.5.2 sell the goods at the best readily obtainable price and (after deducting all reasonable storage and selling expenses) account to you for any excess over the price you agreed to pay for the goods or charge you for any shortfall below the price you agreed to pay for the goods.
6.6 If you fail to take delivery because you have cancelled your contract under the The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 the Supplier shall refund or re-credit you within 14 days for any sum that has been paid by you or debited from your credit card for the goods, less any expenses incurred for failed delivery.
6.7 Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, PCbuyIT will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, PCbuyIT will inform you as soon as possible.
6.8 Time for delivery shall not be of the essence. The goods may be delivered by PCbuyIT in advance of the quoted delivery date.
6.9 Upon receipt of your order you will be asked to sign for the goods received in good condition. If you are unable to check the contents of the package at that moment in time please sign for the parcel as "UNCHECKED". Failure to do so may affect any warranty claims that you make thereafter.
6.10 You shall report any damage or shortage to PCbuyIT in writing within 3 working days of delivery. Provided prompt notice of transit damage or loss is given and provided it is proved to the PCbuyIT's satisfaction that such damage occurred in transit, PCbuyIT will refund, repair or replace such goods free of charge to you.
Risk / Title
7.1 The goods are at your risk from the time of delivery.
7.2 Ownership of the goods shall not pass to you until PCBuyIT has received in full (in cash or cleared funds) all sums due to it in respect of:
7.3 the goods, and
7.4 all other sums which are or which become due to PCbuyIT from you on any account.
7.5 PCbuyIT shall be entitled to recover payment for the goods not withstanding that ownership of any of the goods has not passed from PCbuyIT.
8. Damage or Loss in Transit
8.1 We shall repair or replace, free of charge any Goods damaged or lost in transit where delivery has been made by our carrier, provided that you give us written notification of such damage or loss within 14 days of the date of our invoice (so that we may comply with our carrier's conditions of carriage).
9.1 Where we have put drawings, photographs, illustrations, specifications, performance data, dimensions and the like in sales literature, on web pages or other documentation, we believe they are accurate. However, you should not take them to be a description of the Goods or representations made by us and we do not warrant that they are accurate.
9.2 The specification for Goods may be changed by the manufacturer at any time up to delivery. We will not be liable for any loss or damage suffered in connection with any change. We will use our reasonable endeavours to advise you of any such impending variation as soon as we are able or upon our receiving notice of the same (as appropriate). You must check specifications for Goods prior to making an order. You may cancel the Contract according to your rights set out in condition 10a, below.
10. Your right to cancellation
10.1 Under the United Kingdom's Distance Selling Regulations, you have the right to cancel the Contract for the purchase of any of the Goods within 14 days of delivery. We will be happy to exchange the Goods or provide you with a full refund for the price of the Goods provided that, where delivery has taken place, you have returned the Goods to us in the same condition that they were delivered. We regret that we cannot accept the return of any Software sent to you sealed which has been opened. Unless we agree otherwise with you in writing
10.2 This right of return is in addition to any other rights, warranties or conditions available to you. (For example, there are terms implied into our Contract with you under the Supply of Goods and Services Act 1982 (as amended) which we cannot exclude).
10.3 If you exercise your right of cancellation after the Goods have been delivered to you, please EMAIL our Sales team firstname.lastname@example.org We would then ask you to package any Goods (if applicable) securely in the original packaging. Please record the returns number on a label attached to the outer packaging i.e. please do not write on or damage the box. Our return address is:

10.5 For your protection, we recommend that you use a recorded delivery service. Please note that you will be responsible for the costs of returning the Goods to us unless we delivered the items to you in error or the Goods are faulty. If you do not return the Goods as required, we may charge you a sum not exceeding the direct costs of recovering the Goods
11.Delay or Failure to perform
11.1 We shall not be liable to you if we are prevented or delayed in the performing of any of obligations to you if this is due to any cause beyond our reasonable control including: an act of God, explosion, flood, fire or accident; war or civil disturbance; strike, industrial action or stoppages of work; any form of government intervention; a third party act or omission; failure by you to give us a correct delivery address or notify us of any change of address.
12. Governing Law
12.1 The Contract is governed by the laws of England and the English courts shall have the non-exclusive jurisdiction to resolve any disputes arising out of or under it.
12.2 No waiver by us of any breach of the Contract by you is considered as a waiver of any subsequent breach of the same or any other provision.
